Terms of Use and Sale

Effective date: October 28, 2026. These Terms are live while our legal counsel reviews them and may be updated after that review. Changes will be posted here with a new effective date.

Please read carefully. Section 15 requires most disputes to be resolved by individual arbitration and waives class actions and jury trials.

1. Agreement

These Terms of Use and Sale are an agreement between you and Lazaros LLC, doing business as YUM (“YUM,” “we,” “us”), and they cover www.liveyum.com, our related sites, accounts, and every YUM product. You accept these Terms by using our sites, placing an order, or opening or consuming a YUM product. If you do not agree, do not use the sites. If you bought a product and do not agree, return it unopened under Section 8 instead of using it.

2. Who can buy

You must be at least 21 years old and legally able to buy and possess kratom where you live and where the product is delivered. If you accept these Terms for a business, you confirm that you have authority to bind that business. We may ask for proof of age or identity at any time.

3. Product use and health information

YUM products are botanical kratom shots for adults. We make no medical claims, and nothing on our sites, labels, or social channels is medical advice.

These statements have not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure, or prevent any disease.

WARNING: Kratom may be habit-forming and may cause dependence and opioid-like withdrawal. Do not use while pregnant or breastfeeding. Use may impair judgment; do not drive or operate machinery. May interact with medications, drugs, alcohol, or controlled substances. Not for persons younger than 21 years of age. Consult a healthcare professional before use. Keep out of reach of children.

Follow the label. Talk to a doctor before use, especially if you take medication or have a health condition. To the extent the law allows, you choose to use YUM products voluntarily and accept the risks of using them, including risks from misuse, exceeding the label serving, or combining them with other substances.

4. Lab results (COAs)

Certificates of analysis and lot lookups are provided for transparency. Each one applies only to the batch or lot it names, reflects the testing lab’s methods at the time of testing, and is informational only. They are not medical advice and not a promise of any effect.

5. Where we ship

Kratom is restricted or banned in some states, counties, and cities. We do not ship to places where sale or possession is illegal and may cancel and refund those orders. Restricted states: Alabama, Arkansas, Connecticut, Indiana, Kansas, Louisiana, Tennessee, Vermont, Wisconsin. Restricted local areas: City of San Diego, CA; City of Oceanside, CA; Sarasota County, FL; City of Alton, IL; City of Edwardsville, IL; Village of Glen Carbon, IL; City of Jerseyville, IL; Village of Godfrey, IL; Village of Maryville, IL; City of Marshall, IL; Town of Castle Rock, CO; Town of Monument, CO; Town of Parker, CO; City of Sterling Heights, MI; City of Tupelo, MS; City of Corinth, MS; City of Columbus, MS; City of Oxford, MS; Lowndes County, MS; Pearl River County, MS; Nassau County, NY; Washington County, NY; Oneida County, NY; Albany County, NY; Rensselaer County, NY; Oswego County, NY. Checkout will not accept orders shipping to these locations, and any order that slips through will be cancelled and refunded. This list may change as laws change. You are responsible for knowing and following the laws where you live and where your order is delivered.

6. Orders, prices, and payment

Every order is an offer that we may accept, limit, or decline, including for suspected fraud, resale, or legal concerns. Prices, availability, and descriptions may change and may contain errors; if an item is mispriced, we may cancel the order and refund you. You agree to provide accurate billing and shipping details and authorize us to charge your payment method for each order, including taxes and shipping.

7. Subscribe & Save (automatic renewal)

If you choose Subscribe & Save, you authorize us to charge your payment method automatically at the price and frequency shown at checkout until you cancel. Subscriptions renew automatically. You can skip, pause, change, or cancel from your account or by contacting us before the next billing date; cancellation applies to future shipments. If a subscription price changes, we will notify you before the next charge.

8. Returns and refunds

If you are unhappy with an order, contact us within 30 days of delivery. We will refund unopened products returned in their original condition. Because these are consumable products, opened products are not eligible except when they arrive damaged or defective, or if the law requires a refund. Shipping costs are non-refundable unless we made a mistake.

9. Shipping and risk of loss

Delivery dates are estimates. Risk of loss passes to you when the carrier delivers the order. An adult signature or age check may be required on delivery.

10. Wholesale, retail partners, and the kava bar

Wholesale and retail-partner accounts are also governed by a separate wholesale agreement, including resale, age-verification, and payment terms. If that agreement conflicts with these Terms, the wholesale agreement controls for wholesale orders. Visits to our kava bar may be subject to posted house rules.

11. Accounts, texts, and programs

Keep your login private; you are responsible for activity in your account. Promotions, free-bottle offers, and similar programs may have additional rules, may be limited to one per person or household, and may end at any time.

12. Content, intellectual property, and acceptable use

The YUM name, logos, designs, text, and images belong to us or our licensors. You may use our sites for personal, lawful shopping only. Do not copy or resell our content, scrape or overload the sites, interfere with security, misrepresent your age, or use the sites for unlawful purposes. If you send us reviews, photos, or other content, you give us a non-exclusive, royalty-free license to use it in connection with YUM, and you confirm that you have the right to share it.

13. Disclaimer of warranties

To the fullest extent the law allows, our sites and products are provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, except any that cannot be excluded by law.

14. Limitation of liability and indemnity

To the fullest extent the law allows, YUM and its owners, employees, manufacturers, and distributors are not liable for indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim related to a product or our sites is limited to the amount you paid for the product involved. You agree to defend and hold harmless YUM and those parties from claims that arise from your misuse of a product, your breach of these Terms, or your violation of any law. Some states do not allow these limits, so they may not fully apply to you.

15. Disputes: arbitration and class-action waiver

Before filing a claim, contact us at sales@lunayum.com and give us 30 days to try to resolve it informally. If that fails, you and YUM agree that any dispute related to these Terms, our sites, or our products will be resolved by binding individual arbitration administered by the American Arbitration Association under its consumer rules, instead of in court. Either party may bring an eligible claim in small-claims court instead. You and YUM waive the right to a jury trial and to participate in a class, collective, or representative action. You can opt out of this section by emailing us within 30 days of first accepting these Terms. If the class waiver is found unenforceable, this arbitration section does not apply to that claim.

16. Governing law and general terms

Arizona law governs these Terms, without regard to conflict-of-law rules, except where the Federal Arbitration Act applies. If any part of these Terms is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. We may suspend access or end accounts that break these Terms. These Terms, our Privacy Policy, and any program or wholesale terms are the entire agreement on these topics. We may update these Terms by posting a new version; continuing to use the sites or products after an update means you accept it.
